Alchemy Certified Refurbished Product Warranty 

1. Notice to Consumers

This warranty is given by Alchemy Telco Solutions U.S., LLC whose principal place of business is at 175 Cabot Street, Suite 500, Lowell, MA 01854 ("Alchemy", "we" or "us") for an Alchemy Certified Refurbished Product ("Product"). Alchemy, as the warrantor, points out that in case of Product defects, your statutory rights as the buyer of the Product under the sales contract against the seller remain in force. These rights are not restricted by the following warranty conditions and exist regardless of whether you purchased the Product directly from Alchemy or from an Alchemy approved reseller. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. NOTHING IN THIS WARRANTY IS INTENDED TO EXCLUDE, LIMIT, OR MODIFY ANY RIGHTS YOU MAY HAVE UNDER APPLICABLE FEDERAL, STATE, OR LOCAL LAW, INCLUDING ANY IMPLIED WARRANTIES OR CONSUMER PROTECTION LAWS THAT CANNOT BE EXCLUDED OR LIMITED.

2. Content of the Warranty

2.1 Alchemy grants the buyer of an Alchemy Certified Refurbished Product a voluntary warranty to the extent described below for defects in the product demonstrably due to materials or workmanship when used for normal household purposes during a period of 12 months from the date of purchase (“Warranty Period”).  

2.1 Alchemy grants the purchaser of a Product ("you") a voluntary warranty for defects in the Product demonstrably due to materials or workmanship when the Product is used for the normal / ordinary purposes for which the Product was intended during a period of 12 months from the date of your purchase ("Warranty Period"), subject to the exclusions set out in section 3 below.

2.2 This warranty applies to Products purchased directly from Alchemy or one of its approved resellers for the Warranty Period.

2.3 Product registration is not required to qualify for the warranty.

2.4 The warranty is valid only if the Product is purchased and used in the United States of America.

2.5 The rights and remedies under this warranty may not be assigned or otherwise transferred to a subsequent purchaser of the Product.

3. What the Warranty Does Not Cover and Actions that Could Void the Warranty

This warranty does not cover  

• accessories or consumables (e.g., filters, brushes, bags, cleaning pads or solutions). 
• normal wear and tear, including parts that wear out over time (such as fuse, belt, brush bar, batteries, filters). 
• removal of blockages or clogged filters. 
• intentional cosmetic decoration or modification of the product affecting refurbishment, restoration or usability.  

Moreover, the warranty does not cover defects in the product resulting from 

• accidental damage, including scratches, dents, cracks or broken components. 
• damage caused by weather, fire, liquids, lightning, electrical outages, power surges or other external events. 
• misuse, neglect, careless operation or other inappropriate/negligent use.
• use not in accordance with the operating manual.
• use outside the United States of America.
• operation contrary to the rating plate or without recommended maintenance.
• use for anything other than normal / ordinary purposes for which the Product was intended.
• alteration, repair, disassembly or modification of the Product by a party not authorized by Alchemy.
• use of spare parts or unauthorized cleaning solutions not provided or recommended by Alchemy or Dyson (or the original manufacturer, where applicable).
• your failure to adequately package the Product when transporting it, including in its transportation to Alchemy on a return.
• loss or damage caused by theft or improper installation, maintenance, or storage.
• circumstances outside of Alchemy's control.

3.3 You acknowledge and accept that the Product may inherently contain signs of prior use, including cosmetic imperfections, which are excluded from warranty claims.

3.4 If you are unsure whether a particular Product issue should be addressed under the sales contract with your seller (including exercising your statutory rights) or under this warranty, you should contact your seller for guidance on the issue.

4. What You Must Do to Make a Warranty Claim

4.1 If you believe your Product has a defect covered by this warranty, you must file a claim with Alchemy's customer service during the Warranty Period using the contact details below. Alchemy will confirm your eligibility and provide you with return instructions.

4.2 You must provide proof of purchase, such as your invoice or receipt, when filing your claim. Please do not return your Product without prior authorization from Alchemy. Unauthorized returns may be refused, at Alchemy's sole discretion. Alchemy reserves the right to charge a handling or restocking fee, which shall be paid by you on demand if we determine that you returned a Product that manifestly is not covered under this warranty, or that has been returned without our prior authorization. Such fee shall not be charged if you prove that, under the circumstances, you could not have recognized that your warranty claim was invalid and that you therefore were not at fault.

4.3 If your claim is valid, we will, at our sole discretion, take one of the following actions:

(a) We may repair the defective Product using new, refurbished, or serviceable used parts that are at least functionally equivalent to the original parts; or

(b) We may replace your Product with an identical or similar Product of equal or greater functionality.

An action under (a) or (b) will be free of charge to you, including the usual and necessary shipping, labor, and materials costs associated with such repair or replacement, and will be undertaken within a reasonable period from receipt.

This warranty shall not be renewed or extended following a claim or after service or exchange of your Product. The Warranty Period remains as originally specified from your initial purchase date. Any parts of the Product that are replaced during warranty service become the property of Alchemy.

5. Limitation of Remedies

5.1 EXCEPT AS OTHERWISE REQUIRED BY APPLICABLE LAW, THE RIGHTS AND REMEDIES UNDER THIS WARRANTY REPRESENT THE SOLE AND EXCLUSIVE RIGHTS AND REMEDIES OF THE PURCHASER HEREUNDER FOR A BREACH OF THIS WARRANTY. THIS WARRANTY DOES NOT CONFER ANY RIGHTS TO A CASH ALTERNATIVE. TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL ALCHEMY BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO LOSS OF PROFITS OR LOSS OF USE. Some states do not allow limitation on certain remedies or the exclusion of incidental or consequential damages, so the above limitations may not apply to you.

5.2 This warranty and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts without regards to its conflict of laws principals. Alchemy and you agree that the courts of the Commonwealth of Massachusetts shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this warranty.

Alchemy, en calidad de garante, señala que, en caso de defectos del Producto, sus derechos legales como comprador del Producto en virtud del contrato de compraventa frente al vendedor permanecen plenamente vigentes. Dichos derechos no se ven restringidos por las siguientes condiciones de garantía y existen independientemente de si adquirió el Producto directamente de Alchemy o a través de un distribuidor autorizado por Alchemy. ESTA GARANTÍA LE OTORGA DERECHOS LEGALES ESPECÍFICOS Y USTED TAMBIÉN PUEDE TENER OTROS DERECHOS QUE VARÍAN SEGÚN EL ESTADO. NADA EN ESTA GARANTÍA TIENE POR OBJETO EXCLUIR, LIMITAR O MODIFICAR CUALQUIER DERECHO QUE USTED PUEDA TENER EN VIRTUD DE LA LEGISLACIÓN FEDERAL, ESTATAL O LOCAL APLICABLE, INCLUIDAS CUALESQUIERA GARANTÍAS IMPLÍCITAS O LEYES DE PROTECCIÓN AL CONSUMIDOR QUE NO PUEDAN SER EXCLUIDAS O LIMITADAS.

2. Contenido de la Garantía

2.1 Alchemy concede al comprador de un Producto ("usted") una garantía voluntaria por defectos del Producto que sean demostrablemente atribuibles a materiales o mano de obra, siempre que el Producto se utilice para los fines normales u ordinarios para los que fue diseñado, durante un período de 12 meses a partir de la fecha de su compra ("Período de Garantía"), sujeto a las exclusiones establecidas en la sección 3 a continuación.

2.2 Esta garantía se aplica a los Productos adquiridos directamente a Alchemy o a uno de sus distribuidores autorizados durante el Período de Garantía.

2.3 No es necesario registrar el Producto para acogerse a la garantía.

2.4 La garantía es válida únicamente si el Producto se compra y se utiliza dentro de los Estados Unidos de América.

2.5 Los derechos y recursos derivados de esta garantía no podrán cederse ni transferirse de ningún modo a un comprador posterior del Producto.

3. Qué No Cubre la Garantía y Acciones que Pueden Anularla

3.1 Esta garantía no cubre:

• accesorios o consumibles (por ejemplo, filtros, cepillos, bolsas, almohadillas o soluciones de limpieza).
• el desgaste normal, incluidas las piezas que se deterioran con el uso a lo largo del tiempo (como fusibles, correas, barras de cepillo, baterías o filtros).
• la eliminación de obstrucciones o filtros atascados.
• la decoración cosmética intencionada o la modificación del Producto que afecte a su reacondicionamiento, restauración o usabilidad.

3.2 La garantía no cubre los defectos del Producto resultantes de:

• daños accidentales, incluidos arañazos, abolladuras, grietas o componentes rotos.
• daños causados por condiciones meteorológicas, incendios, líquidos, rayos, cortes eléctricos, sobretensiones u otros eventos externos.
• uso indebido, negligencia, manejo descuidado u otro uso inapropiado o negligente.
• uso no conforme con el manual de funcionamiento.
• uso fuera de los Estados Unidos de América.
• funcionamiento contrario a la placa de características o sin el mantenimiento recomendado.
• uso para fines distintos de los fines normales u ordinarios para los que el Producto fue diseñado.
• alteración, reparación, desmontaje o modificación del Producto por parte de una persona o entidad no autorizada por Alchemy.
• uso de piezas de repuesto o soluciones de limpieza no autorizadas que no hayan sido suministradas o recomendadas por Alchemy o Dyson (o por el fabricante original, cuando corresponda).
• falta de embalaje adecuado del Producto por su parte durante el transporte, incluido su envío de devolución a Alchemy.
• pérdida o daños causados por robo o por una instalación, mantenimiento o almacenamiento inadecuados.
• circunstancias fuera del control de Alchemy.

3.3 Usted reconoce y acepta que el Producto puede contener de forma inherente signos de uso previo, incluidas imperfecciones cosméticas, las cuales quedan excluidas de las reclamaciones de garantía.

3.4 Si no está seguro de si un determinado problema del Producto debe tratarse en virtud del contrato de compraventa con su vendedor (incluido el ejercicio de sus derechos legales) o en virtud de esta garantía, deberá ponerse en contacto con su vendedor para recibir orientación al respecto.

4. Qué Debe Hacer para Presentar una Reclamación de Garantía

4.1 Si considera que su Producto presenta un defecto cubierto por esta garantía, deberá presentar una reclamación ante el servicio de atención al cliente de Alchemy durante el Período de Garantía, utilizando los datos de contacto que se indican a continuación. Alchemy confirmará su elegibilidad y le proporcionará las instrucciones de devolución.

4.2 Deberá aportar un comprobante de compra, como su factura o recibo, al presentar la reclamación. Por favor, no devuelva su Producto sin la autorización previa de Alchemy. Las devoluciones no autorizadas podrán ser rechazadas, a la entera discreción de Alchemy. Alchemy se reserva el derecho de cobrar una tarifa de gestión o reposición, que deberá ser abonada por usted a requerimiento, si determinamos que ha devuelto un Producto que manifiestamente no está cubierto por esta garantía o que ha sido devuelto sin nuestra autorización previa. Dicha tarifa no se cobrará si usted demuestra que, dadas las circunstancias, no podía haber reconocido que su reclamación de garantía era inválida y que, por lo tanto, no actuó con culpa.

4.3 Si su reclamación es válida, podremos, a nuestra entera discreción, adoptar una de las siguientes medidas:

(a) Reparar el Producto defectuoso utilizando piezas nuevas, reacondicionadas o usadas en condiciones de servicio que sean, como mínimo, funcionalmente equivalentes a las piezas originales; o

(b) Sustituir su Producto por un Producto idéntico o similar de funcionalidad igual o superior.

La actuación conforme a los apartados (a) o (b) será gratuita para usted e incluirá los gastos habituales y necesarios de envío, mano de obra y materiales asociados a dicha reparación o sustitución, y se llevará a cabo dentro de un plazo razonable desde su recepción.

Esta garantía no se renovará ni se ampliará tras la presentación de una reclamación ni después del servicio o la sustitución de su Producto. El Período de Garantía seguirá siendo el originalmente establecido a partir de la fecha de su compra inicial. Cualquier parte del Producto que sea sustituida durante el servicio en garantía pasará a ser propiedad de Alchemy.

5. Limitación de Recursos

5.1 SALVO QUE LA LEGISLACIÓN APLICABLE DISPONGA LO CONTRARIO, LOS DERECHOS Y RECURSOS DERIVADOS DE ESTA GARANTÍA CONSTITUYEN LOS ÚNICOS Y EXCLUSIVOS DERECHOS Y RECURSOS DEL COMPRADOR EN VIRTUD DE LA MISMA ANTE UN INCUMPLIMIENTO DE ESTA GARANTÍA. ESTA GARANTÍA NO CONFIERE DERECHO ALGUNO A UNA ALTERNATIVA EN EFECTIVO. EN LA MEDIDA EN QUE LO PERMITA LA LEGISLACIÓN APLICABLE, EN NINGÚN CASO ALCHEMY SERÁ RESPONSABLE DE DAÑOS INCIDENTALES, INDIRECTOS, ESPECIALES O CONSECUENTES, INCLUIDOS, ENTRE OTROS, LA PÉRDIDA DE BENEFICIOS O LA PÉRDIDA DE USO. Algunos estados no permiten la limitación de determinados recursos o la exclusión de daños incidentales o consecuentes, por lo que las limitaciones anteriores pueden no aplicarse en su caso.

5.2 Esta garantía y cualquier controversia o reclamación que surja de la misma o en relación con ella se regirán e interpretarán de conformidad con las leyes del Estado Libre Asociado de Massachusetts, sin tener en cuenta sus principios sobre conflicto de leyes. Alchemy y usted acuerdan que los tribunales del Estado Libre Asociado de Massachusetts tendrán jurisdicción exclusiva para resolver cualquier controversia o reclamación que surja de la presente garantía o en relación con ella.
